2. Description of Service
Amplitrade is a publisher of financial research and education. We provide algorithmic trading signals and model portfolios ("Signals") that subscribers may use as reference information. Amplitrade is not a registered investment advisor, broker-dealer, or financial planner. Nothing we publish constitutes personalized investment advice.
3. Not Investment Advice
All content provided by Amplitrade, including Signals, performance data, commentary, and any other information, is for informational and educational purposes only. You are solely responsible for your investment decisions. Before making any investment decision, you should consult with a qualified financial advisor licensed in your jurisdiction.
4. Risk Disclosure
All investments involve risk, including the possible loss of principal. Past performance is not indicative of future results. The Signals we provide may result in losses. By subscribing, you acknowledge that:
- You understand trading involves substantial risk of loss.
- You are financially able to sustain losses associated with trading.
- Trading performance figures shown on this site do not account for commissions, fees, slippage, or taxes, which will reduce actual returns.
- Our results may not be representative of the results you will achieve.
5. Subscription and Payment
5.1 Subscription Plans
We offer several subscription tiers as described on our Pricing page. Subscriptions are billed monthly or annually as selected at checkout.
5.2 Free Trial
We may offer a free trial period. At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel before the trial ends.
5.3 Billing
Subscriptions are processed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. You represent that you are authorized to use the payment method provided.
5.4 Price Changes
We reserve the right to change subscription prices. We will provide at least 30 days' notice before a price change takes effect for existing subscribers.
6. Refund Policy
We offer a 60-day money-back guarantee on all paid subscriptions. If you are not satisfied within 60 days of your first payment, contact us at support@amplitrade.com for a full refund. After 60 days, subscriptions are non-refundable except where required by law. Cancellation stops future billing but does not entitle you to a refund of past payments.
7. Cancellation
You may cancel your subscription at any time through your account settings or by emailing us. Cancellation takes effect at the end of your current billing period. You retain access to the Service until the end of the paid period.
8. Elite Portfolio Membership Cap
The Elite Portfolio is limited to 500 members to manage position sizing and liquidity. We reserve the right to limit new enrollments or maintain a waitlist. If the limit is reached, we will notify prospective subscribers.
9. Intellectual Property
All content on this site, including text, graphics, logos, algorithms, and software, is the property of Amplitrade and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
You may not share, redistribute, or resell our Signals to third parties.
10. Prohibited Use
You agree not to:
- Resell or redistribute our Signals or content.
- Use the Service for any unlawful purpose.
- Attempt to gain unauthorized access to our systems.
- Engage in any automated data scraping of our site.
- Impersonate another person or entity.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, AMPLITRADE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless Amplitrade and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec, Canada, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved by binding arbitration in Montreal, Quebec, except that either party may seek injunctive relief in a court of competent jurisdiction.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and notifying you by email. Your continued use of the Service after such notice constitutes acceptance of the updated Terms.
16. Termination
We may terminate or suspend your access to the Service immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service ceases immediately.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Amplitrade concerning the Service and supersede all prior agreements.
